President Trump Signs Executive Order Banning Transgender Athletes From Women's Sports

President Trump's Order: "Keeping Men Out of Women's Sports"

President Trump signed an executive order on February 5, 2025, directing federal agencies to withhold funding from educational institutions that allow transgender women to compete in women's sports programs. The order, titled "Keeping Men Out of Women's Sports," represents a significant shift in federal policy regarding transgender athletes' participation in scholastic and collegiate sports.

The executive order cites recent federal court decisions, including Tennessee v. Cardona and Kansas v. U.S. Department of Education, to support its position that allowing transgender women to compete in women's sports categories violates Title IX protections. The administration argues this practice denies cisgender women and girls equal athletic opportunities.

Key provisions of the order include:

The Department of Education must take "appropriate action" to ensure women's sports and facilities are reserved for individuals based on biological sex rather than gender identity. This includes enforcement actions against institutions that do not comply.

Federal agencies are directed to review and potentially rescind funding to educational programs that do not align with the order's policies.

The State Department is instructed to promote sex-based categories in international sports, including working with the International Olympic Committee to amend its standards for women's sporting events.

The order also addresses immigration policy, directing the Departments of State and Homeland Security to review and adjust policies regarding the admission of transgender athletes seeking to compete in women's sports in the United States.

Within 60 days, the Assistant to the President for Domestic Policy must convene representatives from major athletic organizations and state attorneys general to discuss implementing these policies and sharing best practices.

The order builds upon a previous executive order from January 2025 regarding gender identity policies in federal government operations. Implementation of these measures will depend on available appropriations and must comply with existing laws.

Athletic organizations and educational institutions currently have varying policies regarding transgender athlete participation, with some requiring testosterone level documentation and others having no specific requirements. This executive order seeks to establish a uniform approach based on biological sex rather than gender identity or hormone levels.

The implementation and potential legal challenges to this executive order remain to be seen, as it intersects with ongoing debates about Title IX interpretation, athletic fairness, and transgender rights.
